Domestic violence issues are nowadays being one of the global issues which are faced by every country around this world, India is amongst that in which the cases of domestic violence are increasing after stricter laws too. It becomes one of the challenging issues for India to look into and protect women from violence in every aspect.Many countries are facing this pandemic situation. India is amongst one of the countries that went for a complete lockdown and staying at home to fight against this novel coronavirus.

This lockdown, on one hand, has brought many families together and on the other hand, has proven atrocious for some families about rising in the case of domestic violence cases against women. The women fight from both sides, with the perpetrator and outside with the virus. In this pandemic situation, women are not left with any other option being in the household confined with criminals. 

The UN report has recently analysed the impact of COVID-19 on women, urging nation-states to include the prevention of violence against women and girls as a part of their COVID-19 action plan. In India, the number of domestic violence complaints received by the National Commission for Women has doubled from 123 distress calls to 239 domestic violence complaints, from 23 March 2020, to 16 April 2020[1]. According to the secondary data available the rise in domestic violence case is being increase in this lockdown situation. Compared with the decade past data the spike is increased. Most of the cases are been reported form the states such as Uttar Pradesh, Haryana, Bihar and Punjab.[2]

REASONS:-

1. The more common reason leading to violence can be loss of income the man sitting at home without any source of economic income feels helpless and making them angry. This scenario is worse in case, if any female is working and cannot bring income home, which is use for their livelihood of the family can cause violence against women. 24 × 7 locked up with the husband makes them more vulnerable and prone to violence.

2. As due to lock down maids were not coming home for housework. As a patriarchal society is shape like women are made for doing housework and men are made to go to the office, and outside work. This has woken up the fire between the couples and leads to domestic violence.

3. substance use disorder is also a common factor that leads to domestic violence. These reasons have worsen the practise of domestic violence as liquor shops were also locked down the husband drinks at home and due to economic instability cannot purchase alcohol that leads to domestic violence.

4. Unable to socialise with the people confined in one space is also the most common reason for domestic violence against women.

5. As our patriarchy is focus on male dominant society, women not respecting men and not taking a stand in the wrong things can also trigger the husband for violence against women.

6. Also, the women are domestically harm for not bringing the dowry and not fulfilling the desires of the husband. The husband’s family molest the women mentally by not giving food for weeks and keeping locked in one, space. Also, torture her physically and verbally by beating, slapping, and also using abusive language.

So these are some reasons in which ground the cases are filed in the court. The list is not exhaustive as many women fear in filing the case, and they do not report it. So in the next segment, we are going to discuss what all measures were being takes by the government in this pandemic situation

MEASURES HAVE BEEN TAKEN BY THE GOVERNMENT DURING LOCKDOWN PERIOD

As  India is not seeing the decreasing number of rates in the domestic violence case. Many of the Indian states have seen rise keeping in mind the measures takes to curb this practise are-

1. The national commission for women has started with a new campaign providing WhatsApp helpline number i.e 91 7217735372 that is for the period of lockdown for filing the complaints of domestic violence. As there are also so many links and website portals in which we can file a complaint, this WhatsApp number will act as additional help in the women’s.[3]

2. Two of the ministry has collaborated to provide mental support, and psychological health of the person in danger. The helpline number generated for this purpose is 0804611007. It is an additional perk add and an older perk is also available the emergency number 112 for the helping of women in danger.

3. Ministry of Children and women have generated and arranged special webinar guiding the authorities helping the women for domestic violence. The ministry is advising them to support them in mental, and psychological support. Furthermore, do better counsel to know their mindset.

4. In this situation the J&K high court has ordered that in that state to take the cases on domestic violence as urgent as possible and to try to focus on this case first. Also increase the online platform for complaint and to increase the awareness by campaign or nukadnatak etc.,

5. In this situation, several NGOs are also coming forward and helping a person reach a safe place away from the perpetrators and to provide counselling by making them comfortable and calm.

So these are the measures takes by the government, and the court for fighting against this evil practise.

SUGGESTIONS WHAT GOVERNMENT CAN DO

• The measures that the government can include are women’s protection from domestic violence should not only be confine with marry women but also women’s living in a live-in relationship with the partner. The ruling was adjudicat in case of Savitabhensomabhaibhatiya vs. The state of Gujarat and ors[4] Supreme Court held under section 3-protection to be given to both.

• Also by providing online support is not sufficient as many women’s do not have access to mobile phones. They are locked up with the perpetrator, so it is not possible for the abuser to ask for help. So the government can ask for a

survey like going to house and see whether everything is going on right or not?

• The person who is not financially stable, the government in this situation should help in online counselling session by themselves. Fixing their timetable with the lawyers, pshyctarist, mediators, etc.,

• Same like a European centre the government can ask for the informal complaint’s location in a grocery shop, medical shops. These measures are not only for this pandemic situation it  can help them for life long purposes.

• The law and administrators should bring effective enforcement until we fight form this virus. Both points To be keep in mind the women’s safety and the pandemic situation.

• Effective law enforcement mechanism should be there so that perpetrators should fear in doing such an evil practise.

• The society needs to be more upgraded not patriarchal. As our grand norm constitution of India has also incorporated the provision of equality regarding men and women. Furthermore it has removed all forms of discrimination.

CONCLUSION

For removing this practise, the government has made so many measures in this lockdown period but that is not

efficient for every woman out there. Like as stated above the government needs to be more vigilant and should create a door to door check survey. Also, the government should help poor ladies to look for a counselling session and

know their rights and the remedies available to them by the awareness programmes to be conduct in every rural area frequently.

Also, the government should make women more powerful in themselves so that they can fight against violence by sitting at home. Some training programmers for self-protection shall be conducted and teach the women they are not less than anyone out there,

as guaranteed under the constitution they are equal.The government should bring more

efficient laws and the punishment so that the criminals should fear in doing such acts again.
