1. What are the licenses under the FSSAI?

Ans: The FSSAI has three licenses based on the size of business. If the busines is small whose turnover is less than twelve Lakhs then the mere registration with the FSSAI is sufficient. If the business is Medium scale then the company requires to fulfil the state license i.e., Turnover between twelve lakhs to twenty crores. Then if the business is operating in more than one state on a large scale then Central License is require whose turnover is more than twenty crores.

2. What is improvement notice?

Ans: An improvement notice is if a Food Business Operator fails to comply with the food regulations set in the FSS Act, 2006. An improvement notice can be issued by a Designated Officer (DO) of the food safety department. Here the person is also given the opportunity to file a case against the order within fifteen days. The decision of the FSSAI High Court will be termed as final unless the person appears before Supreme Court.

3. Can a license be modified? What is the fee for such modification?

Ans: If you intend to make changes to your license, you can do so. If you wish to make changes to the information in Form C a modification fee may apply which is equal to a one-year license fee. There are no charges levied for changes to other parts of the license.

Ans: All Food Business Operators and, including medical stores, have to get FSSAI license/registration. It is mandatory, and non-compliance may result in heavy penalties.

Ans: The Validity of the license ranges from one year to a maximum period of five years.

Ans: For the export of food products from India, there is no requirement of obtaining a NOC from FSSAI.

12. What happens if different food services are carried on in one premise?

Ans: FSSAI license is based on-premise. All kinds of food business activities that are being carry out at the same premise can be applied for in a single FSSAI license.

13. Who is exempt from obtaining license of Organic food?

Ans: Owners whose turnover is less than twelve lakhs is exempt from obtaining license for Organic Food.

14. Is E-inspection allowed?

Ans: Yes, due to the outbreak of Covid-19 e-inception has been temporarily allowed by the government i.e., with images, live camera etc.

15. Can the authorities have physical check after e-inspection?

Ans: Yes, the Authorities has the right to do so only after giving notice of their schedule to the respective license holder.

Ans: For the time being the government has allowed temporary licenses and they can further issue a permanent licenses only if they are satisfied by the conduct of the license holder.

Ans: Yes, the Government has granted grace period for the renewal of license till 31st December.

Ans: In this case the person has to take the approval of the “Proprietary Foods” and not the regulations of the FSSAI

Ans: A registration certificate has to be issue by the registration authority within seven days of the date of making application.

Ans: Person can approach Commissioner of Food Safety under Sec.32 of the FSSAI Act and for Central License you can apply to the Regional Officer.

Ans: Non-submission of annual return beyond 31st May of every year will attract a late fee of Rs. 100 per day till the date of submission of annual return

Ans: The late fees of 100rs are charge per day.

Ans: Yes, the additional permission is require which the local district collector notifies us.
